Rav David Brofsky Chashud al Ha-shevu'a This week we will take a closer look at the principle of "chashud al ha-shevu'a," that one who has been proven to be a thief, or one who has previously taken a false oath, is disqualified from taking a shevu'a. Masekhtot - Iyun (Gittin / Pesachim)
Rav Yair Kahn Takfa Echad Befaneinu R. Zera raises a question relating to the case of our mishna "shnayim ochazim be-tallit" - Takfa echad be-faneinu mahu - what is the halakha if one of the two litigants grabs the entire tallit in our (beit din's) presence? Masekhtot - Iyun (Gittin / Pesachim)
Harav Baruch Gigi Tefisa Bi-Sefeikot - Seizure in questionable cases In our sugya the conclusion of most of the Rishonim is that if a kohen seized a questionable bekhor (firstborn), the halakha is that we take it away from him. This is because tefisa bi-sefeikot (seizure in questionable cases - whether there is a doubt concerning the identity or ownership of an object or if the ruling of the case in general is questionable) is not effective. However, from other sugyot it seems that tefisa (seizure) is effective. Masekhtot - Iyun (Gittin / Pesachim)
Rav Yair Kahn Shiur #18: Minyan Ha-raui The laws of ma'aser beheima obligate one to set aside one of ten animals born to his flock in any given year and to offer it as a sacrifice. Masekhtot - Iyun (Gittin / Pesachim)
Rav Yair Kahn 7a Modeh Bi-shtar She-katvo According to Torah law, a shtar signed by two witnesses, is valid, although the authenticity of their signatures was not verified. Nevertheless, Rabbinic law demands that the signatures be verified, in order to diminish the possibility of forgery. This process is known as "kiyum hashtar." Masekhtot - Iyun (Gittin / Pesachim)
Rav Mordechai Friedman Shnayim Adukin Bi-Shtar In the context of the discussion of Shnayim adukin be-tallit (Bava Metzia 7a) (two people holding onto a garment, each claiming full ownership), the gemara introduces, by way of comparison, the case of Shnayim adukin bi-shtar. Masekhtot - Iyun (Gittin / Pesachim)
Rav Yair Kahn Bava Metzia 8a: Lifting a Metzia Together The Mishna indicates that when two people lift a metzia together, each person acquires half of the object. Rami Bar Chama tried to prove from this that one can establish ownership over an object for another person. Masekhtot - Iyun (Gittin / Pesachim)
Rav Ezra Bick Kinyan Meshikha Regarding Animals The Gemara in Masekhet Bava Metzia (9a) records Rabbi Yehuda's comment, "In truth, one does not establish ownership unless there is meshikha [pulling] – when acquiring a camel – or hanhaga [driving, or leading] – when acquiring a donkey." Masekhtot - Iyun (Gittin / Pesachim)
Rav Moshe Taragin Chav Le-achrini - Disqualifying Shelichut Which Harms Third-Party Interest The convention of shlichut (halakhic agency) is a familiar and widespread concept in Halakha. Many halakhic activities such as kinyan, kiddushin, gittin, and hekdesh can be performed indirectly through an agent (shaliach). Masekhtot - Iyun (Gittin / Pesachim)
Rav Moshe Taragin Migu De-zakhi Le-nafshei - Acting As an Agent While Damaging Third-Party Interest This week's shiur will inspect a situation in which shlichut DOES succeed EVEN THOUGH others are negatively impacted. Masekhtot - Iyun (Gittin / Pesachim)
